We Fight Any Claim Ltd (‘We’ or ‘WFAC’) will carry out a Free PPI Check for you. Our claims team will make a Subject Access Request (SAR) (or similar) to your creditor(s) for information about all loan, mortgage, credit card, store card, hire purchase agreement(s) or Packaged Bank Accounts (PBA) that you currently have or have had in the recent past. The claims team will then carry out a thorough review to verify whether any policies of Payment Protection Insurance (PPI) exist alongside your credit agreement(s) or whether you have paid for a PBA.
If our review indicates that any PPI or PBA products were sold to you, we will contact you to inform you and confirm whether or not you wish to use WFAC’s Claim Service. If you tell us you want to proceed with WFAC’s claim service we will then discuss the circumstances surrounding the sale of your PPI policies and/or PBA. This will enable us to prepare a detailed claim to present to your creditor(s) if it appears that PPI or PBA may have been mis-sold to you. We will then pursue a claim on your behalf for reimbursement of all PPI premiums and/or PBA charges and interest paid on your loan, mortgage, credit card, store card, hire purchase agreement(s) or packaged bank accounts plus statutory interest.
Please note: the Financial Ombudsman Service (FOS) also offers a free adjudication service.
We do not charge any fee for our Free PPI Check service. For our Claim Service we charge a fee equal to £290.00 for every £1,000.00 (29% including VAT) of any PPI or PBA compensation we recover for you. This fee is payable once you have received an award of compensation from your creditor(s) or received a credit to your account or an offset against any arrears or overdraft on your account.
No Win, No Fee
If we do not achieve an offer of compensation for you from your creditor(s) then you will not have to pay us anything.
“Compensation” means any financial benefit that is awarded to you (prior to the deduction of any tax) from a PPI or PBA claim (or a claim dealt with in relation to any other financial or insurance product incidental to a PPI or PBA claim) including a cash payment, or a credit to a loan or other account you may hold (including any accounts you did not identify or specify to us) or an offset of any arrears or overdrafts on any such accounts (including any payments relating to distress or inconvenience and any payments made on a goodwill or ex gratia basis).
Your claim will be deemed ‘successful’ if you receive an award of compensation relating to any money you have previously paid or been charged in respect of the PPI policy or if you receive any equivalent credit to your account with your lender or if any payment made to you by your creditor is offset against any arrears or overdraft on your account.
Compensation will be awarded to you either via a lump sum payment, an amendment to your existing loan or a combination of both. Which method is adopted will depend upon your circumstances and your creditor.
You took out a loan and at the same time you paid £750.00 for a PPI product to protect your loan repayments. You have since paid the loan off.
We recover compensation of £1,000.00 for you (£750.00 plus interest). This may be in the form of a cash payment (or where you have a current loan or credit card) it may be applied as a credit to your account. Our total fee in either case will be £290.00 (29% including VAT).
Two years ago you took out a 5 year loan. At the same time you paid £750.00 for a PPI product to protect your loan repayments. You are currently £1,200.00 in arrears with your loan repayments. We recover compensation of £1,000.00 for you (£750.00 plus interest). Your creditor will be entitled to apply the compensation to your loan account to reduce your arrears to £200.00. In that case, our fee of £290.00 (29% including VAT) will be payable by you to us.
You were sold a PBA 3 years ago. You were charged a monthly fee of £20.00 for this. We recover £1,000.00 compensation (being a refund of PBA charges plus interest). Your creditor may pay you this in cash or apply it as a credit to your bank account. Our total fee in either case will be £290.00 (29% including VAT).
Important Notes: IIf you are in arrears with your loan or credit card repayments or if your bank account is overdrawn, your creditor may use some or all of your compensation to offset your arrears or reduce your overdraft. In these circumstances you will still remain liable to pay our fees in full.
If you are in a Debt Management Plan, if you receive any compensation for mis-sold PPI or a mis-sold PBA from a creditor who is part of your Debt Management Plan you must inform your Plan provider. If you do not you may prejudice any arrangements with your creditors under that Plan.
If you are currently in an Individual Voluntary Arrangement (IVA), if you receive any offer of compensation for mis-sold PPI or a mis-sold PBA you must inform your IVA Supervisor. If you do not, your IVA may be put at risk. Also, this may result in any compensation going directly to your IVA Supervisor. If you are in any doubt, you should contact your IVA Supervisor.
If you were previously in an IVA, if you receive any offer of compensation for mis-sold PPI or a mis-sold PBA you must inform your IVA Supervisor. If you do not, your IVA may be put at risk. Also, this may result in any compensation going directly to your IVA Supervisor. If you are in any doubt, you should contact your IVA Supervisor.
If you were previously in an IVA, if you receive any offer of compensation for mis-sold PPI you may (depending upon the terms of your previous IVA) be obliged to pay some or all of your compensation to your previous IVA Supervisor. If you do not inform your previous IVA Supervisor of an offer of compensation you receive from one of your creditors, you may be liable to pay some or all of your compensation to your previous IVA Supervisor but you would still be liable to pay some or all of our fees. If you are in any doubt, you should check the terms of your previous IVA.
If at any time we believe that the likely amount of any compensation does not justify the work involved on our part necessary to pursue your claim or if the likely value of your claim is less than any arrears on your account, we reserve the right to cease acting for you in relation to such claims.
We do not guarantee to find all PPI you may have been sold but we will make reasonable enquiries based on the information you provide to us.
It is possible that your lender may withhold payment of basic rate income tax on the interest element of any compensation you receive. In these circumstances our fee of 29% (including VAT) will be payable upon the gross sum awarded to you, prior to the deduction of any tax.
For us to act on your behalf, we will require that you agree to our Terms and Conditions by signing our Engagement Letter. A copy of our Terms and Conditions have been sent to you which you should keep for your records. Further copies are available on our website and in paper format upon request.
Your Right To Cancel
If you tell us you wish to cancel within 14 days of the date your claim(s) for compensation are submitted to your Creditor(s) we will cancel your agreement with us and you will owe us nothing unless you have received a reasonable offer of compensation within this period. If you tell us you wish to cancel after more than 14 days have passed since your claim(s) were submitted to your creditor(s), you will still be liable for We Fight Any Claim’s fee of 29% (including VAT) if at the time of cancellation an award of compensation is or has been made to you by any creditor which We Fight Any Claim has dealt with on your behalf. This applies even if you cancel this agreement before you have decided to accept an award of compensation.
